Fees & Charges By-Law


BY-LAW NUMBER 2007-37

BEING A BY-LAW TO SET FEES AND CHARGES

WHEREAS Section 391. (1) of the Municipal Act states that despite any Act, a municipality and a local board may pass by-laws imposing fees or charges on any class of persons,

(a) For services or activities provided or done by or on behalf of it;

(b) For costs payable by it for services or activities provided or done by or on behalf of any other municipality or local board; and,

(c) For the use of its property including property under its control.

AND WHEREAS Section 396. (1) Of the Municipal Act states that a by-law under this part may provide for,

(a) Interest charges and other penalties, including the payment of collection costs, for fees and charges that are due and unpaid;

(b) Discounts and other benefits for early payment of fees and charges;

(c) Fees and charges that vary on any basis the municipality or local board considers appropriate and specifies in the by-law, including the level or frequency of the service or activity provided or done, the time of day or of year the service or activity is provided and whether the class of persons paying the fee or charge are residents or non-residents of the municipality;

(d) Different classes of persons and deal with each class in a different way; and,

(e) The exemption, in whole or in part, of any class of persons from all or any part of the by-law. 2001, c. 25, s. 396 (1).

BE IT RESOLVED THAT THE COUNCIL OF THE CORPORATION OF THE MUNICIPALITY OF ST.-CHARLES ENACTS AS FOLLOWS:

1. In this By-law:

(a) 'Municipality' means the Corporation of the Municipality of St.-Charles

(b) 'Clerk' means the Clerk of the Municipality of St-Charles, and includes the Deputy Clerk

(c) 'Fire Chief means the Fire Chief for the Municipality of St.-Charles, and includes the Deputy Fire Chief

(d) 'Applicant' means any person applying for a permit to carry out certain works on properties within the boundaries of the Corporation of the Municipality of St.-Charles

(e) 'Chief Official' means the Chief Building Official and Plumbing Inspector appointed by the Council of the Corporation of the Municipality of St.- Charles for the purposes of enforcement of the Building Code Act, the Regulations made there under, and the Building By-Law of said corporation

(f) 'Director of Public Works' means the Director of Public Works appointed by Council of the Corporation of the Municipality of St.-Charles

(g) 'Treasurer' means the Treasurer of the Corporation of the Municipality of St.-Charles

2. The municipality will apply all fees for materials, services, information, documents as prescribed in schedules A-F, which form part of this by-law.

3. The fees set out in the schedules to this by-law may be reduced or waived by the Clerk in the event the charging of the fee would be a hardship.

4. All by-laws inconsistent with this by-law are hereby repealed.

5. This by-law may be cited as the Fees and Charges By-Law.

6. This by-law shall come into force and effect immediately upon the final passing thereof
